The report of the Commissioner for Fundamental Rights

The Commissioner for Fundamental Rights, unless he conducts an administrative procedure regulated in another law, shall prepare a report on the findings and conclusions of his inquiries conducted pursuant to the provisions set out in Act CXI of 2011 on the Commissioner for Fundamental Rights (hereinafter referred to as: the CFR Act), which shall also contain the measures proposed for remedying the exposed violations of fundamental rights, if any.

The Commissioner for Fundamental Rights shall determine the measures that he deems necessary for remedying the fundamental rights impropriety established in the report within the framework of the CFR Act, by himself.

The following measures of the Commissioner for Fundamental Rights bear special significance:

  • recommendations, which are addressed to the supervisory organ of the authority under review, by simultaneously informing the authority in question;
  • initiatives, which are formulated by the Commissioner for Fundamental Rights for the authority in question for the termination of the impropriety in their own competence.

The reports are issued by the Commissioner for Fundamental Rights in each case, however, the reports concerning national minority rights and the interests of future generations (issues concerning environmental protection or environmental rights) can also be co-published with the Deputy Commissioner in charge of the legal area in question.

The deputies of the Commissioner for Fundamental Rights are not entitled to issue reports independently.

   

 

Policy statements 

The Deputy Commissioners may make their statements concerning the legal area that they are in charge of (national minority rights and the interests of future generations) in the form of policy statements issued after a professional consultation with the Commissioner for Fundamental Rights.

In the policy statements, the experience concerning the legal fields monitored by the Deputy Commissioners, related to the enforcement of the rights of national minorities and future generations can be summarized.

Pursuant to the CFR Act, the addressees have no obligation to respond to the proposals set out in the policy statements. However, the addressees may elaborate a meaningful position on the policy statement based on their own decision and inform the Deputy Commissioner thereon.

On 29 October 2024, Dr. Ákos Kozma, Commissioner for Fundamental Rights of Hungary, and Dr. Elisabeth Sándor-Szalay, Deputy Commissioner for the Rights of National Minorities in Hungary, attended the meeting of the Parliamentary Committee on Nationalities in Hungary. The session focused on Report no. B/7848 on the activities of the Commissioner for Fundamental Rights of Hungary and his deputies in 2023.
